The Palestinian Authority’s (PA) envoy to the United Nations on Friday formally requested membership in the International Criminal Court (ICC), which would allow war crimes complaints to be filed against Israel, reports AFP."This is a very significant step," envoy Riyad Mansour told reporters. "We are seeking justice for all the victims that have been killed by Israel, the occupying power."Secretary General Ban Ki-moon is to review the so-called instruments of accession and notify state members on the request within 60 days, the report noted."We are honored that we are the 123rd state-party of the ICC, which will be effective in about 60 days from now in accordance with the rules and procedures of the ICC," Mansour said.The PA envoy submitted the so-called instruments of accession to the United Nations' top legal affairs official, Stephen Mathias, at UN headquarters in New York.PA Chairman Mahmoud Abbas signed requests to join the ICC and 16 other conventions on Wednesday, a day after the Security Council failed to adopt a resolution paving the way to full statehood.The United States has branded the move to seek ICC membership as "counterproductive" and warned it would only push the sides further apart.According to AFP, Mansour said the PA had also filed a request with the ICC in The Hague to grant retroactive jurisdiction to the court to cover alleged war crimes committed during last year's Gaza war.Mansour said the PA will also be seeking to launch legal action over Jewish settlement construction, which he said was a war crime under the Rome Statute."This is a peaceful option, a civilized option and an option that anyone who upholds the law should not be afraid of," he said.Even if the PA files the charges, legal rights experts say that having the ICC enter the fray of the Israeli-Arab conflict will ultimately harm the PA, Hamas, and the ICC itself - not Israel.In a recent interview, the PA's envoy to the United Nations Human Rights Council (UNHRC) admitted the PA has no hope of pressing charges against Israel in international courts - because Palestinian Arab terrorist groups are far worse violators of international law themselves.Prime Minister Binyamin Netanyahu has called on the ICC “to reject out of hand the hypocritical request of the Palestinian Authority, since the Palestinian Authority is not a state.”(Arutz Sheva’s North American desk is keeping you updated until the start of Shabbat in New York. The Palestinian Authority (PA) signed the Rome Statue on Wednesday advancing a push to sue Israel for "war crimes" at the International Criminal Court (ICC), but the path for such a move has been paved by intense "lawfare" and propaganda against Israel for decades by NGOs, according to NGO Monitor.
The Jerusalem-based research center detailed how major NGOs including Amnesty International, Human Rights Watch, and European-funded NGOs Palestinian Center for Human Rights, Al Haq, Diakonia and FIDH, brought about the ICC move through years of lobbying."Attempting to litigate the highly charged Arab-Israeli conflict in the ICC could spell the end of the court, and the NGOs and their European funders will be responsible," said Anne Herzberg, NGO Monitor Legal Advisor. "While the Palestinian leadership and the NGOs may get some short-lived propaganda victories in their political war, they may soon find they got more than they bargained for."The reason for that is that legal experts - including the PA's own UN human rights envoy and a former ICC chief prosecutor - have assessed the move can lead to counter-prosecutions of officials from all the Palestinian Arab factions over war crimes committed against Israelis. European governments are a key backer in providing funds for the NGOs that have campaigned for years to allow this move, and often that funding occurs via "secretive and irresponsible processes that lack transparency and accountability," reports NGO Monitor.Palestinian Center for Human Rights gets funds from the European Union (EU), Norway and Ireland; Al Haq receives from Ireland, Belgium, Spain and Norway; FIDH is funded by France, EU, Sweden, Norway and Ireland; and Diakonia, a Swedish church-based NGO, gets most of its funding from the Swedish government.So how do these European-backed NGOs wage their "lawfare" against the Jewish state? One of their prime mechanisms if the Secretariat, a joint framework of funding by Denmark, the Netherlands, Sweden and Switzerland which is managed by the Institute of Law at Birzeit University. The funding mechanism has long given the financial support needed for NGOs to wage legal campaigns delegitimizing Israel and advancing Palestinian Arab narratives and goals.
"Ironically, in order to convince governments to support the ICC, Human Rights Watch has argued for years that the court would never be exploited for political maneuvers by the Palestinians," said Herzberg. "Once again, Human Rights Watch has been proven wrong."There are also NGOs functioning within Israel, including Adalah and Yesh Din, which advance the false accusation of a lack of due process in Israel's justice system to push for international "war crimes" cases. Both NGOs are funded by European governments and the New Israel Fund (NIF).Herzberg concluded saying "given that the Palestinians have committed tens of thousands of war crimes against Israeli civilians, they may find themselves facing prosecution not only for war crimes but crimes against humanity and genocide."The PA's ICC move comes after its resolution at the UN Security Council unilaterally demanding recognition and Israeli withdrawals failed this week.Explaining the move to Arutz Sheva, Shurat Hadin (Israel Law Center) director Nitsana Darshan-Leitner said the highly politicized nature of the ICC means Israel is likely to lose such a case despite the falseness of the charges, a prospect that likely would lead to sanctions.She added that the only deterrent against the PA actually fulfilling its threat is that it would lead to a bevy of war crimes charges against them as well, and likewise would lead Israel and the US to pull funding for the PA, effectively dismantling it.

Palestinian Authority (PA) chief negotiator Saeb Erekat announced on Thursday to James Rawley, the UN's Deputy Special Coordinator for the Middle East Peace Process, which international conventions the PA signed onto the day before in breach of the Oslo Accords.Erekat announced that PA chairman Mahmoud Abbas in a Wednesday meeting not only signed onto the Rome Accords, allowing the PA to join the International Criminal Court (ICC) and sue Israel for "war crimes," but also signed "the state of Palestine" on to a whole slew of international conventions, as reported in Arabic by the official PA news source WAFA and listed below.The PA similarly breached the Oslo Accords by signing international conventions back in April when it torpedoed the peace talks with Israel, a process of crashing the talks that was sealed when the PA signed a unity deal with Hamas.It's most current move comes after the PA's bid at the UN Security Council unilaterally demanding recognition and Israeli withdrawals failed. Experts asses the ICC move would open the PA up to war crime suits for its involvement in terrorism against Israelis, and likely cause Israel and the US to drop their funding of the PA, effectively collapsing it.Erekat told Rawley that the "state of Palestine," by signing onto the conventions, obligates itself to changes its laws in accordance with them. He also mentioned that the unilateral press at the UN was a "legitimate right" and expressed a desire to see "Palestine back on the map.""We guard our people in every place, and the crimes committed against our people in eliminating them, settlements, destruction, and aggression against Gaza, they haven't passed statutes of limitations and those who commit the crimes need to deal with the results," Erekat said.He added "we demand that the US consider our position, because as is the strength of a nation great so is the responsibility on it great.""Palestine relies on international law, and therefore we demand that the US again consider its relations with Israel, stop treating it like a nation above the law and stand at the right-hand of international legitimacy regarding the end of Israeli settlement and eliminations," Erekat said."Whoever wants to defeat terrorism in the region must deal with the roots of the Israeli occupation as a preface to defeating terror," claimed Erekat, saying "settlements" will be the main focus of the PA's lawsuits at the ICC.

What did Abbas sign?

Erekat's announcement listed the conventions Abbas signed onto, prime among them the Rome Statute of the International Criminal Court; the Agreement on the Privileges and Immunities of the ICC; and the Declaration in the accordance with the Rome Statute of the ICC.Others signed include: Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents; Convention on the non-applicability of statutory limitations to war crimes and crimes against humanity; UN Convention against Transnational Organized Crime.There were more general ones signed as well, such as the Basel Convention on the control of transboundary Movements of Hazardous Wastes and their Disposal; UN Convention on the Law of the Sea; Convention on Biological Diversity; Convention on the Law of the Non-Navigational Uses of International Watercourses.Likewise the PA signed the Protocol Additional to the Geneva Conventions...relating to the Protection of Victims of Non-International Armed Conflicts (Protocol II); Protocol Additional to the Geneva Conventions...relating to the Adoption of an Additional Distinctive Emblem (Protocol III); Convention on the Political rights for Women; Convention on the safety of the UN and Associated Personnel; Convention on the recognition and enforcement of foreign arbitral awards (the New York Convention).The Treaty On The Non-Proliferation Of Nuclear Weapons; Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be deemed to be Excessively Injurious or to have Indiscriminate Effects; and Convention on Cluster Munitions rounded out the list.

Prime Minister Binyamin Netanyahu held an emergency meeting at the prime minister's office in Tel Aviv on Thursday to discuss the Palestinian Authority (PA) attempt to join the International Criminal Court (ICC), so as to sue Israel for "war crimes."PA chairman Mahmoud Abbas launched the ICC move by signing the Rome Convention on Wednesday along with a whole slew of other international conventions - in breach of the Oslo Accords - after his attempt to press for recognition and Israeli withdrawals at the UN Security Council fell short."We expect the international court to reject out of hand the hypocritical request of the Palestinian Authority, since the Palestinian Authority is not a state," pointed out Netanyahu at the conclusion of the meeting.Indeed, Abbas signed on to the Rome Convention and the others he requested to join as the "state of Palestine."Elaborating on this point, Netanyahu said the PA "is an entity that has a treaty with a terrorist organization, Hamas, which commits war crimes, and the state of Israel is a lawful nation with an ethical army that observes all international laws.""We will defend the IDF soldiers as they defend us," added Netanyahu, responding to the PA intention to sue soldiers for "war crimes."Experts asses the ICC move would open the PA up to war crime suits for its involvement in terrorism against Israelis, and likely cause Israel and the US to drop their funding of the PA, effectively collapsing it. Israel for its part may face sanctions given the politicized nature of the ICC, which would likely rule against it despite the falsehood of the charges.In an interesting turn of events Foreign Minister Avigdor Liberman (Yisrael Beytenu) was not invited to the meeting.Sources in the foreign ministry criticized Netanyahu for not inviting Liberman, accusing him of wanting to avoid "challenging" suggestions from the foreign minister. They added that the results of the meeting were known in advance, and therefore only clerks from Netanyahu's office were invited.

Ahmed Bahar, acting speaker of the Palestinian parliament, on Thursday poured cold water on Palestinian Authority (PA) Chairman Mahmoud Abbas’s application to join the International Criminal Court (ICC) and several other international conventions and treaties.In a statement, Bahar said that Abbas bears responsibility for the applications which, he claimed, do not serve the interests of the “Palestinian people.”Bahar stressed that any signing of a treaty or an international agreement requires national responsibility and the entire Palestinian parliament must approve it.Thursday’s statement stands in sharp contrast to Hamas’s statement from Wednesday, in which it praised Abbas's move as a "step in the right direction.""This step needs to be part of a general policy and a joint national program," Hamas said in a statement.Hamas's previous embrace of the ICC bid oddly contrasts with its utter rejection of the PA's UN draft resolution to boot Israel out of Jewish communities in Judea and Samaria, which it said in multiple statements did not 'represent the Palestinian people.Hamas's spokesman said last week the resolution "doesn't represent [the] consensus of the Palestinian people," and Hamas leader Mahmoud al-Zahar added that the draft resolution in favor of Palestinian statehood was "disastrous," and that it has "no future in the land of Palestine."The last elections for the PA parliament were held in 2006, and Hamas won an overwhelming majority. The group later staged a bloody military coup in Gaza in the summer of 2007, creating a rift between Abbas’s Fatah movement in Ramallah and the Hamas-led government in Gaza.The sides formed a unity government last year but the government has been unable to function and there have been signs that it is crumbling.The most recent reconciliation attempt has been rocked by tensions, most notably Hamas's attempt to stage a violent coup in Judea and Samaria against the Palestinian Authority.
