The United States said Monday it was reviewing its annual $440-million aid package to the Palestinian Authority (PA) because of its effort to join the International Criminal Court (ICC) to pursue war-crimes charges against Israel, reports The Associated Press (AP).The PA formally presented a request to the United Nations on Friday to join the ICC, in a move firmly opposed by both Israel and the United States.“We’re deeply troubled by the Palestinian action,” State Department spokeswoman Jen Psaki told reporters on Monday, adding that joining the court “is entirely counterproductive and does nothing to further the aspirations of the Palestinian people for a sovereign and independent state. It badly damages the atmosphere with the very people with whom they ultimately need to make peace.”At the same time, Psaki also criticized Israel’s move to freeze the transfer of tax revenues to the PA in retaliation for its bid to join the ICC, saying it was a step “that raises tensions as others do.”Under American law, noted AP, any PA case against Israel at the court would trigger an immediate cutoff of U.S. financial support. Membership itself, however, doesn’t automatically incur U.S. punishment.Secretary of State John Kerry discussed the matter by telephone over the weekend with Israeli Prime Minister Binyamin Netanyahu. Other American officials spoke with PA Chairman Mahmoud Abbas, hoping to dissuade him from his course.The administration is reviewing its assistance to the Palestinians to ensure it complies with U.S. law, Psaki said, adding there is a range of ways for the U.S. to respond, but suggested none would happen immediately.In September of 2011, a $192 million aid package was frozen by Congress after the PA submitted a failed unilateral bid for United Nations membership.Members of Congress later released $40 million in economic and humanitarian funding for the PA, saying it is “vital to establishing and strengthening the foundations necessary for a future Palestinian state.”In April of 2012, President Barack Obama bypassed a Congress block and signed a waiver declaring that aid to the Palestinian Authority is “important to the security interests of the United States.”

Shurat HaDin (Israel Law Center) has filed three more war crimes suit against Palestine Liberation Organization (PLO) officials in the International Criminal Court (ICC) in the Hague.The NGO says that while the Palestinian leadership can be indicted for terror acts carried out from 2002 onward, Israel can only be indicted for deeds done from the day the PLO joined the Rome Statute - the request to join was signed last week.The three new complaints, against PLO leaders Jibril Rajoub, Majid Faraj and Rami Hamdallah, follow the Israeli NGO's previous ground-breaking ICC complaints against Hamas leader Khaled Mashaal (filed in September) and against PLO and Palestinian Authority (PA) Chairman Mahmoud Abbas (filed in November) for war crimes and human rights violations.Shurat HaDin accuses the three Palestinian civilian officials of terrorism, torture and civil rights violations which are all international law offenses and actionable under the Rome Treaty of the ICC. Today's filings are the first war crimes complaints filed against senior Palestinian officials since PLO leader Mahmoud Abbas signed the Rome Treaty late last week.Jibril Rajoub is Deputy Secretary of the Fatah Central Committee and is second to Abbas within Fatah, a terrorist faction within the PLO. Majid Faraj is head of Palestinian General Intelligence while Rami Hamdallah was previously minister of the interior in the Palestinian Authority (PA), and now serves as prime minister.The Shurat HaDin complaint demands the investigation and arrest of Rajoub, contending that Rajoub was a leader of Fatah at the time the terrorist group was responsible for numerous rocket attacks on Israeli civilians, during the summer's Gaza War.Targeting civilians with deadly weapons constitutes a war crime under international law. Fatah has boasted on its Facebook page and in other social media that it – and not just Hamas or other factions – was responsible for launching rockets at Israel this summer.As a senior Fatah leader, Rajoub should be held responsible for the actions of his subordinates, who act according to the terrorist faction's policies and goals, said Shurat Hadin in a press release, noting that the terrorist rocket attacks from Gaza left numerous Israelis dead and injured.The complaint also alleges that Faraj and Hamdallah knowingly employ torture against ordinary Palestinians. As senior officials responsible for agencies within the Palestinian security apparatus, Faraj and Hamdallah are “liable for the widespread civil rights abuses and killings which were perpetrated by those agencies,” the NGO charged.The complaint requests that the Chief Prosecutor of the ICC investigate Faraj and Hamdallah for torture and murder and issue warrants for their arrest.

PLO 'playing with fire'

Shurat HaDin Chairperson Attorney Nitsana Darshan-Leitner explained that all three men can be prosecuted in the ICC for offenses dating back to 2002 because, “These PLO officials are all Jordanian citizens and Jordan has been a member of the ICC since its founding in 2002.”The ICC is empowered to exercise its jurisdiction over all acts committed by the citizen of a member state, wherever those acts are committed, from the date the state was granted membership.Darshan-Leitner noted that almost all of the PLO leadership possesses Jordanian citizenship. In deciding to sign the Rome Statute, she added, “The Palestinian leadership is playing with fire. The Palestine Authority can only file complaints going forward, because court jurisdiction over acts committed within its territory begins at the date that a state joins the court. Abbas can only complain about future events which occur in the presently undefined territory of the Palestinian Authority because Abbas attempted to join the ICC only now.“The Palestinian leadership, however, may be tried by the ICC for the many terrorist acts and human rights abuses, including the Second Intifada, for which they are responsible, dating back to 2002, because they are Jordanian citizens and that is when Jordan joined the court.”As such, she elaborated, the ICC is compelled to investigate the war crimes and international law violations perpetrated by the PLO officials who retain Jordanian citizenship immediately without waiting for the Palestinian Authority's membership application to be approved.According to Darshan-Leitner: “Abbas and his colleagues in the Hamas terrorist organization believe that the ICC is a weapon to be used against Israel, and that the crimes of Palestinian leaders against their own people and terrorist attacks against Israeli civilians will go unpunished. All PLO and Hamas officials need to understand that the ICC is a two edged sword and their years of murder, terrorism and hate will now be brought before the prosecutors for investigation."

The new United States Congress, which convenes Tuesday with Republicans in control of the House and Senate, plans to challenge President Barack Obama on several issues, including the sanctions on Iran, reports The Associated Press (AP).Republicans who have accused Obama of being feckless in dealing with Syria, the Islamic State (ISIS) and Iran will push for a more confrontational strategy. They want to consider legislation penalizing Iran and authorizing force against ISIS, Monday’s report noted.Last week, diplomats said Iran and the U.S. have tentatively agreed on a formula that Washington hopes will reduce Tehran’s ability to make nuclear arms by committing it to ship to Russia much of the material needed for such weapons, a report which was later denied by Iran.In another sign of progress, the two diplomats told AP that negotiators at the December round of nuclear talks drew up for the first time a catalog outlining areas of potential accord and differing approaches to remaining disputes.The diplomats said differences still dominate ahead of the next round of Iran-six power talks on January 15 in Geneva. But they suggested that even agreement to create a to-do list would have been difficult previously because of wide gaps between the sides.While Washington and its partners are hoping to clinch a deal with Iran by July that would set long-term limits on Iran’s enrichment of uranium and other activity that could produce material for use in nuclear weapons, Republicans say the Senate will vote within weeks on a bill to impose more sanctions on Tehran.
Congressional lawmakers have warned Obama in the past they will work to increase sanctions on Iran if the administration makes what they consider a bad deal over Tehran's nuclear program.Last year, a bill was introduced by Robert Menendez (D-NJ) and Mark Kirk (R-Ill) to impose new sanctions on Iran if international negotiations on curbing its nuclear ambitions falter.The bill was gaining momentum in Congress, but Obama lobbied hard against it and has more than once threatened to veto the bill if it passes.On a visit to Israel last month, Sen. Lindsey Graham said the bipartisan sanction legislation says: “If Iran walks away from the table, sanctions will be re-imposed. If Iran cheats regarding any deal that we enter to the Iranians, sanctions will be re-imposed.”Graham also is sponsoring legislation that would require any deal with Iran to be approved by Congress before sanctions could be lifted, noted AP.

Syria has complained to the United Nations (UN) about several officials who, it claims, entered the country without visas in violation of its sovereignty.These include Republican Senator John McCain, former French Foreign Minister Bernard Kouchner and former U.S. diplomat Peter Galbraith, according to Reuters.Syria's UN ambassador, Bashar Ja'afari, called on UN Secretary-General Ban Ki-moon and the 15-member Security Council to pressure governments to take "the necessary measures against their nationals who enter Syrian territory illegally.""Such actions are a blatant violation of Syria's sovereignty and of the resolutions of the Security Council concerning Syria," Ja'afari wrote in a letter dated Dec. 30 and seen by Reuters on Monday.He complained generally about "certain journalists and prominent figures" entering Syria illegally but singled out McCain for entering Syria in June 2013. McCain visited Syria in May 2013 and met with some Syrian rebels, his spokesman said at the time.Ja'afari also cited Kouchner for visiting in November 2014, Galbraith for traveling to Syria in December 2014 with other U.S. political and military leaders, and former Kuwaiti politician Walid al-Tabtaba'i for entering Syria in September 2013.McCain, been a vocal opponent of President Barack Obama's Syrian policy, has in the past repeatedly called for his country to take action in the civil war in Syria, saying that Syrian President Bashar al-Assad will make no effort to end the country’s civil war as long as he is winning on the battle field.Syria has used the tactic of complaining to the UN over “violation of its sovereignty” in the past, including complaining against Israel over alleged airstrikes in the country.
