And it is worth thinking about the media’s role in the overall strategy of one of the world’s most dangerous and evil criminal enterprises, Hamas. Much of the Western media is acting as Hamas’s air force in a battle plan that actually includes — by design, on Hamas’s part — the very kind of reporting the world is witnessing on TVs and smartphones and in newspapers around the world.Hamas knows that much of the Western media will spin the narrative in terms of moral equivalency, at best, and, at worst, as a narrative about Israel as occupier and the Palestinian residents of Gaza as innocents — about Israel the Goliath, and Gaza Palestinians the David; about Israel the guilty power, and Gaza Palestinians the innocent casualties.But those casualties in Gaza are not innocent. The deaths of all those women and children are not collateral damage but part of a deliberate plan — not of Israel’s design but Hamas’s.Indeed, dead Gaza children are the goal of the Hamas campaign – more than dead Israeli children, which is a part of the Hamas Covenant.The truth is that dead women and children in Gaza are the lifeblood of the Hamas campaign. The slaughter of their own innocents is a public-relations tactic to gain sympathy from Western media. The very same media are either predisposed to side against Israel for any reason or incapable of distinguishing between good and evil.The latter does Hamas’s bidding by perpetuating the myth that there are two morally competing visions at war in Gaza.But anyone with any sense knows there is no real moral equivalency between the government of Israel and Hamas. How can that be when there have been recent reports that Hamas and Islamic Jihad are transporting themselves around the streets of Gaza in ambulances packed with children? Israel, on the other hand, sends its soldiers into the streets of Gaza at great risk, and does so to mitigate civilian casualties. Israel goes to great lengths to spare innocent lives, dropping leaflets, where and when they can, warning the people of Gaza of impending strikes.What’s Hamas’s response? So determined is Hamas to give media the story the media crave, its leaders convince their own people to ignore the warnings. Indeed, the stark difference between Israel and Hamas was summarized in one perfectly calibrated sentence by Israel’s prime minister, Benjamin Netanyahu. “We’re using missile defense to protect our civilians,” he explained, “and they’re using their civilians to protect their missiles.”As Charles Krauthammer pointed out in a recent Washington Post column, rarely is the world presented with such striking moral clarity. The Washington Post’s editorial page actually had the guts to call Hamas’s strategy what it is: depraved.What no one is really pointing out is the depravity of many media outlets for treating this tragic situation as something it is not. It is not a conflict between two legitimate and competing visions of life. Were it not for the Western media’s work in furthering the narrative of disproportionate retaliation, and moral equivalency, and were it not for the media’s steadfast refusal to face their own complicity in Hamas’s murderous endgame, Hamas would cease its perverse use of children and women as human shields and return to the old-fashioned strategy of using women and children as human bombs.Even the most committed Hamas apologists can’t excuse such activity. Blaming Israel for the dead children of Gaza is a much easier moral lift.The truth is that few in the media are pointing out their own complicity in Hamas’s overarching strategy. But then again, the media are not very good at turning the cameras on themselves — or at asking themselves hard questions. Like it or not, Western media are the point of the spear in Hamas’s plan to delegitimize Israel and destroy it. And yet the media act like innocents, as if they were witnesses rather than enablers.One thing is certain. It’s a long-running reality-TV series Hamas is producing and directing in Gaza. It is supplying real-life victims and choreographing their deaths. And the Western media are covering the story without conveying the stark reality of the degree to which it is scripted. Indeed, the Western media are playing precisely the role that the leaders of Hamas hoped they would play, acting as the distribution arm of the terrorist organization’s snuff film.Does anyone believe Hamas would be doing what it has been doing in Gaza if the media revealed its insidious modus operandi? While Israel disputes the accounts, the evidence suggests that Israel committed the following six offenses:
1-Violating its duty to protect the civilian population of the Gaza Strip. Despite Israel’s 2005 “disengagement” from Gaza, the territory remains occupied. Israel unleashed military firepower against a people it is legally bound to protect.
2-Imposing collective punishment in the form of a blockade, in violation of Article 33 of the Fourth Geneva Convention. In June 2007, after Hamas took power in the Gaza Strip, Israel imposed suffocating restrictions on trade and movement. The blockade — an act of war in customary international law — has helped plunge families into poverty, children into malnutrition, and patients denied access to medical treatment into their graves. People in Gaza thus faced Israel’s winter onslaught in particularly weakened conditions.
3-Deliberately attacking civilian targets. The laws of war permit attacking a civilian object only when it is making an effective contribution to military action and a definite military advantage is gained by its destruction. Yet an Israeli general, Dan Harel, said, “We are hitting not only terrorists and launchers, but also the whole Hamas government and all its wings.” An Israeli military spokeswoman, Maj. Avital Leibovich, avowed that “anything affiliated with Hamas is a legitimate target.”Israeli fire destroyed or damaged mosques, hospitals, factories, schools, a key sewage plant, institutions like the parliament, the main ministries, the central prison and police stations, and thousands of houses.
4-Willfully killing civilians without military justification. When civilian institutions are struck, civilians — persons who are not members of the armed forces of a warring party, and are not taking direct part in hostilities — are killed.International law authorizes killings of civilians if the objective of the attack is military, and the means are proportional to the advantage gained. Yet proportionality is irrelevant if the targets of attack were not military to begin with. Gaza government employees — traffic policemen, court clerks, secretaries and others — are not combatants merely because Israel considers Hamas, the governing party, a terrorist organization. Many countries do not regard violence against foreign military occupation as terrorism.Of 1,434 Palestinians killed in the Gaza invasion, 960 were civilians, including 121 women and 288 children, according to a United Nations special rapporteur, Richard Falk. Israeli military lawyers instructed army commanders that Palestinians who remained in a targeted building after having been warned to leave were “voluntary human shields,” and thus combatants. Israeli gunners “knocked on roofs” — that is, fired first at corners of buildings, before hitting more vulnerable points — to “warn” Palestinian residents to flee.With nearly all exits from the densely populated Gaza Strip blocked by Israel, and chaos reigning within it, this was a particularly cruel flaunting of international law. Willful killings of civilians that are not required by military necessity are grave breaches of the Geneva Conventions, and are considered war crimes under the Nuremberg principles.
5-Deliberately employing disproportionate force. Last year, Gen. Gadi Eisenkot, head of Israel’s northern command, speaking on possible future conflicts with neighbors, stated, “We will wield disproportionate power against every village from which shots are fired on Israel, and cause immense damage and destruction.” Such a frank admission of illegal intent can constitute evidence in a criminal prosecution.
6-Illegal use of weapons, including white phosphorus. Israel was finally forced to admit, after initial denials, that it employed white phosphorous in the Gaza Strip, though Israel defended its use as legal. White phosphorous may be legally used as an obscurant, not as a weapon, as it burns deeply and is extremely difficult to extinguish.Israeli political and military personnel who planned, ordered or executed these possible offenses should face criminal prosecution. The appointment of Richard Goldstone, the former war crimes prosecutor from South Africa, to head a fact-finding team into possible war crimes by both parties to the Gaza conflict is an important step in the right direction. It was called the Racketeer Influenced and Corrupt Organizations Act, and the law was passed in the early 1970s. It helped put an end to an era of sprawling organized-crime families, to the Mafia as we knew it.Most Americans know the statute’s acronym, RICO, and that it allows prosecution for racketeering activity performed as part of an ongoing criminal enterprise. Such activity may include illegal gambling, bribery, kidnapping, murder, money laundering, counterfeiting, embezzlement, drug trafficking, slavery, and a host of other unsavory business practices. If a criminal enterprise commits murder and extortion, members from top to bottom can be prosecuted as if they committed the crimes themselves.As we watch media accounts of Israel’s military move in Gaza, it is worth thinking about RICO. And it is worth thinking about the media’s role in the overall strategy of one of the world’s most dangerous and evil criminal enterprises, Hamas. Much of the Western media is acting as Hamas’s air force in a battle plan that actually includes — by design, on Hamas’s part — the very kind of reporting the world is witnessing on TVs and smartphones and in newspapers around the world.Hamas knows that much of the Western media will spin the narrative in terms of moral equivalency, at best, and, at worst, as a narrative about Israel as occupier and the Palestinian residents of Gaza as innocents — about Israel the Goliath, and Gaza Palestinians the David; about Israel the guilty power, and Gaza Palestinians the innocent casualties.But those casualties in Gaza are not innocent. The deaths of all those women and children are not collateral damage but part of a deliberate plan — not of Israel’s design but Hamas’s.Indeed, dead Gaza children are the goal of the Hamas campaign – more than dead Israeli children, which is a part of the Hamas Covenant.The truth is that dead women and children in Gaza are the lifeblood of the Hamas campaign. The slaughter of their own innocents is a public-relations tactic to gain sympathy from Western media. The very same media are either predisposed to side against Israel for any reason or incapable of distinguishing between good and evil.The latter does Hamas’s bidding by perpetuating the myth that there are two morally competing visions at war in Gaza.But anyone with any sense knows there is no real moral equivalency between the government of Israel and Hamas. How can that be when there have been recent reports that Hamas and Islamic Jihad are transporting themselves around the streets of Gaza in ambulances packed with children? Israel, on the other hand, sends its soldiers into the streets of Gaza at great risk, and does so to mitigate civilian casualties. Israel goes to great lengths to spare innocent lives, dropping leaflets, where and when they can, warning the people of Gaza of impending strikes.What’s Hamas’s response? So determined is Hamas to give media the story the media crave, its leaders convince their own people to ignore the warnings. Indeed, the stark difference between Israel and Hamas was summarized in one perfectly calibrated sentence by Israel’s prime minister, Benjamin Netanyahu. “We’re using missile defense to protect our civilians,” he explained, “and they’re using their civilians to protect their missiles.”As Charles Krauthammer pointed out in a recent Washington Post column, rarely is the world presented with such striking moral clarity. The Washington Post’s editorial page actually had the guts to call Hamas’s strategy what it is: depraved.What no one is really pointing out is the depravity of many media outlets for treating this tragic situation as something it is not. It is not a conflict between two legitimate and competing visions of life. Were it not for the Western media’s work in furthering the narrative of disproportionate retaliation, and moral equivalency, and were it not for the media’s steadfast refusal to face their own complicity in Hamas’s murderous endgame, Hamas would cease its perverse use of children and women as human shields and return to the old-fashioned strategy of using women and children as human bombs.Even the most committed Hamas apologists can’t excuse such activity. Blaming Israel for the dead children of Gaza is a much easier moral lift.The truth is that few in the media are pointing out their own complicity in Hamas’s overarching strategy. But then again, the media are not very good at turning the cameras on themselves — or at asking themselves hard questions. Like it or not, Western media are the point of the spear in Hamas’s plan to delegitimize Israel and destroy it. And yet the media act like innocents, as if they were witnesses rather than enablers.One thing is certain. It’s a long-running reality-TV series Hamas is producing and directing in Gaza. It is supplying real-life victims and choreographing their deaths. And the Western media are covering the story without conveying the stark reality of the degree to which it is scripted. Indeed, the Western media are playing precisely the role that the leaders of Hamas hoped they would play, acting as the distribution arm of the terrorist organization’s snuff film.Does anyone believe Hamas would be doing what it has been doing in Gaza if the media revealed its insidious modus operandi? While Israel disputes the accounts, the evidence suggests that Israel committed the following six offenses:
1-Violating its duty to protect the civilian population of the Gaza Strip. Despite Israel’s 2005 “disengagement” from Gaza, the territory remains occupied. Israel unleashed military firepower against a people it is legally bound to protect.
2-Imposing collective punishment in the form of a blockade, in violation of Article 33 of the Fourth Geneva Convention. In June 2007, after Hamas took power in the Gaza Strip, Israel imposed suffocating restrictions on trade and movement. The blockade — an act of war in customary international law — has helped plunge families into poverty, children into malnutrition, and patients denied access to medical treatment into their graves. People in Gaza thus faced Israel’s winter onslaught in particularly weakened conditions.
3-Deliberately attacking civilian targets. The laws of war permit attacking a civilian object only when it is making an effective contribution to military action and a definite military advantage is gained by its destruction. Yet an Israeli general, Dan Harel, said, “We are hitting not only terrorists and launchers, but also the whole Hamas government and all its wings.” An Israeli military spokeswoman, Maj. Avital Leibovich, avowed that “anything affiliated with Hamas is a legitimate target.”Israeli fire destroyed or damaged mosques, hospitals, factories, schools, a key sewage plant, institutions like the parliament, the main ministries, the central prison and police stations, and thousands of houses.
4-Willfully killing civilians without military justification. When civilian institutions are struck, civilians — persons who are not members of the armed forces of a warring party, and are not taking direct part in hostilities — are killed.International law authorizes killings of civilians if the objective of the attack is military, and the means are proportional to the advantage gained. Yet proportionality is irrelevant if the targets of attack were not military to begin with. Gaza government employees — traffic policemen, court clerks, secretaries and others — are not combatants merely because Israel considers Hamas, the governing party, a terrorist organization. Many countries do not regard violence against foreign military occupation as terrorism.Of 1,434 Palestinians killed in the Gaza invasion, 960 were civilians, including 121 women and 288 children, according to a United Nations special rapporteur, Richard Falk. Israeli military lawyers instructed army commanders that Palestinians who remained in a targeted building after having been warned to leave were “voluntary human shields,” and thus combatants. Israeli gunners “knocked on roofs” — that is, fired first at corners of buildings, before hitting more vulnerable points — to “warn” Palestinian residents to flee.With nearly all exits from the densely populated Gaza Strip blocked by Israel, and chaos reigning within it, this was a particularly cruel flaunting of international law. Willful killings of civilians that are not required by military necessity are grave breaches of the Geneva Conventions, and are considered war crimes under the Nuremberg principles.
5-Deliberately employing disproportionate force. Last year, Gen. Gadi Eisenkot, head of Israel’s northern command, speaking on possible future conflicts with neighbors, stated, “We will wield disproportionate power against every village from which shots are fired on Israel, and cause immense damage and destruction.” Such a frank admission of illegal intent can constitute evidence in a criminal prosecution.
6-Illegal use of weapons, including white phosphorus. Israel was finally forced to admit, after initial denials, that it employed white phosphorous in the Gaza Strip, though Israel defended its use as legal. White phosphorous may be legally used as an obscurant, not as a weapon, as it burns deeply and is extremely difficult to extinguish.Israeli political and military personnel who planned, ordered or executed these possible offenses should face criminal prosecution. The appointment of Richard Goldstone, the former war crimes prosecutor from South Africa, to head a fact-finding team into possible war crimes by both parties to the Gaza conflict is an important step in the right direction. After two terror attacks in Jerusalem Monday afternoon, police said they would be out in force throughout Tisha B'Av to ensure the safety of Jews visiting the Kotel.On Monday night, groups will take part in the traditional march around the walls of the Old City, to express the Jewish yearning for the rebuilding of the Temple.The route of the march will be from the New Gate to the Damascus Gate, from there to the Flowers Gate and onward to the Lion's Gate. Special speakers will be appearing at the Lion's Gate, including Minister of Building and Housing, Uri Ariel, Head of the Samaria Regional Council, Gershon Mesika, Ariyeh Eldad, Head of Professors for a Strong Israel, and Daniel Luria, of the Ateret Cohanim organization. The march will end at the Dung Gate near the Kotel (Western Wall). All are invited to bring family, friends, a copy of Eicha, and Israeli flags. The event has been approved by the Israeli Police.

On a visit to Ashkelon, Yaalon said that the IDF needed “a little more time” to finish up its operations to destroy Hamas' terror tunnels.Yaalon said that the tunnel threat would be removed from Israel after the war was over. In any case, he said, the defense establishment was prepared to ensure that Hamas terrorists who tried to sneak into Israel via tunnels or other methods would be stopped. In addition, he said, Israel would insist that all rocket fire at Israel be stopped.Yaalon added that residents of Gaza would do well to take stock of their situation, and to think about who they wanted leading them. Had Hamas used the cement Israel allowed into Gaza for the construction of homes and schools instead of terror tunnels, things might have turned out different.Prime Minister Binyamin Netanyahu, also said Monday afternoon that Operation Protective Edge is not over, despite a redeployment of forces. In practice, it is Hamas that is attacking them and denying them humanitarian aid. I think that the international community needs to strongly condemn Hamas and also demand, just as we are demanding, that the rehabilitation of Gaza be linked to its demilitarization.On Monday night, Israeli media outlets, quoting Egyptian sources, said that Hamas and Islamic Jihad had agreed to an Egyptian demand for a three-day cease-fire. The sources said that the cease-fire could go into effect as soon as Tuesday morning.According to UN officials, Gaza sustained at least $5 billion in damage over the past month and a half of IDF shelling and ground action.
